Prosecutors moved to dismiss a felony charge of injury to the elderly against current New England Patriots defensive end Michael Bennett.

Bennett was indicted by a Harris County grand jury in March 2018 for an alleged incident at the end of Super Bowl LI in February 2017. An elderly security guard in a wheelchair said Bennett pushed her arm as he attempted to celebrate with his brother, Martellus, on the field.

Michael Bennett was a member of the Seattle Seahawks at the time. He signed with the Patriots this offseason. Martellus Bennett joined the Patriots for the championship 2016 season.

"We dismissed this case in the interest of justice," Vivian King, chief of staff for Harris County District Attorney Kim Ogg, said in a statement Wednesday. "After looking at all the evidence, this was the right thing to do."

Evidence included surveillance video from the investigation into Tom Brady's stolen jersey.

"There was probable cause to warrant a charge initially, but after a careful review of all the pre-charge and post-charge evidence, we cannot prove this case beyond a reasonable doubt," King said.
