From the GNU General Public License version 3:
Some devices are designed to deny users access to install or run modified versions of the software inside them, although the manufacturer can do so. This is fundamentally incompatible with the aim of protecting users' freedom to change the software. The systematic pattern of such abuse occurs in the area of products for individuals to use, which is precisely where it is most unacceptable. Therefore, we have designed this version of the GPL to prohibit the practice for those products. According to Microsoft:
"What does Built on Open Source mean?
"Microsoft Visual Studio Code is a Microsoft licensed distribution of 'Code - OSS' that includes Microsoft proprietary assets (such as icons) and features (Visual Studio Marketplace integration, small aspects of enabling Remote Development). While these additions make up a very small percentage of the overall distribution code base, it is more accurate to say that Visual Studio Code is "built" on open source, rather than "is" open source, because of these differences."

Microsoft takes advantage of free software for its own commercial advantage. The statement 'built on' is Microsoft attempting to redefine the open source licence, claiming a proprietary licence as it has added an 'extension'.
