Hamilton driver charged in Dundas hit-and-run

Hamilton Police arrested a 27-year-old Hamilton man on Sept. 19, five days after a hit-and-run collision on Old Ancaster Road in Dundas in which an 84-year-old male cyclist was injured.

The driver was charged with careless driving and failing to remain at the scene, under the Highway Traffic Act. None of the allegations have been proven in court.

Further information, including a first court appearance date, was not available by deadline.

The 84-year-old cyclist was taken to hospital following the Sept. 14 collision with a large laceration to the back of his head. His injuries were considered non-life-threatening.

Police had no update on the cyclist's medical status as of Oct. 1.

Conviction on both charges could potentially mean a fine between $800 and $4,000, up to 12 months in jail and driver's licence suspension for up to four years.

The act states a court that imposes a sentence for careless driving shall consider as an aggravating factor evidence that bodily harm or death was caused to a person who, in the circumstances of the offence, was vulnerable to a lack of due care and attention or reasonable consideration by a driver, including by virtue of the fact that the person was a pedestrian, cyclist or a person working upon the highway."

The area of the collision, north of Dundana Avenue, has been the subject of several resident safety concerns and reviews by City of Hamilton over the past seven years. A city road safety technologist reviewing the area in summer 2019 left the city that fall.
