The NFLPA filed an emergency motion on Ezekiel Elliott's behalf Tuesday that will allow the Dallas Cowboys running back to appeal a judge's decision to reinstate his six-game suspension.

New York judge Katherine Failla, who reinstated Elliott's suspension Monday, denied the NFLPA's motion for a stay of her decision, pushing the appeal to the 2nd Circuit Court, according to Kate Hairopoulos of The Dallas Morning News.

Elliott had 24 hours to appeal the decision handed down from judge Failla on Monday night. She dissolved his temporary restraining order against the NFL after finding it was within the league's collectively bargained rights to suspend Elliott, even though he was never charged following a domestic abuse investigation.

Elliott has rushed for 690 yards and six touchdowns through seven games this season, adding 210 yards and two touchdowns receiving.
