Man shot by Hamilton police in Cannon Street parking lot has died

A 42-year-old man shot by Hamilton police this week has died.

The Special Investigations Unit confirmed the man, shot in the parking lot of Corner's Variety on Cannon Street East at Gage Avenue North, died of his injuries a day after being shot.

The shooting happened around 4 p.m. Tuesday, July 7 after police were called about a domestic incident involving a firearm.

Police located the suspect in the parking lot, and when they approached, there was an interaction" and two officers fired, the SIU said.

The 42-year-old, whose name has not been released, was taken to hospital in critical condition. The SIU said he died of his injuries and was pronounced dead at 3:15 p.m. July 8.

Investigators seized two police-issued firearms and a shotgun from the scene.

Two officers have been designated subject officers" - meaning they are the subjects of the investigation - and four have been designated witnesses officers. The witness officers have been interviewed.

The SIU is an arms-length agency that investigates incidents involving police in Ontario where someone is seriously hurt, killed or there is an allegation of sexual assault.

Hamilton police have confirmed they were called about a domestic incident involving a suspect armed with a gun about a half-hour before the shooting. The service has declined to comment further citing the SIU investigation.

This is the eighth fatal Hamilton police shooting since 2007.

The last fatal police shootings happened in 2018 with the deaths of Quinn MacDougall, on April 3, and Robyn Garlow, on Oct. 20. Both of those cases involved people in crisis armed with a knife, the SIU concluded.

In all of the seven previous shootings, the SIU cleared police of wrongdoing, finding those killed were armed with weapons. Police are allowed to use lethal force when they reasonably believe their life or the life of someone else is in danger.

The investigation into the latest shooting is ongoing. Anyone with information is asked to call the SIU at 1-800-787-8529.
