The Electronic Frontier Foundation's last-ditch attempt to get back user data from the seized Megaupload servers has been shot down.

In a two-page order on Friday, the US Court of Appeals for the 4th Circuit denied (PDF) the EFF's request on behalf of Kyle Goodwin.

"Although, as Mr. Goodwin points out, his motion for return of property has been pending for a significant period of time without decision, we do not find on this record that the district court refused to adjudicate the matter," wrote the unanimous three-judge panel. "Accordingly, the petition for writ of mandamus is denied without prejudice."
